CONTENT LICENCE AGREEMENT (for Crestock customers)

1. All images are suitable for use both in printed form and electronically, i.e. internet and screen display. Flash animations are suitable for internet and screen display only.
   


2. The copyright of the Content remains with the Supplier. The Suppliers are committed to obtain a Model Release where necessary.
   


3. All Suppliers that have Content displayed on www.crestock.com have agreed to sell the right to use the Content as described below in paragraphs 5-11. They are also responsible for having acquired all permissions from models and other copyright holders for the sale of the right to use as described in the following paragrapsh 5-10.
   


4. The download of Content from this website can only legally take place when paid for, and the buyer confirms that these terms are read and agreed upon.
   


5. The payment grants the buyer the right to download only one copy of the chosen file.
   


6. Referring to paragraph 5, the buyer acquires an unlimited right of use for the chosen Content, hereby the right to produce several copies thereof, forhis/her own use or for his/her employer's use, but only if the Content is bought for this employer. In the case of marketing, design, promotion, advertising and new media consultancies and agencies this licence only grants use of the Content in materials produced for one client/company.
   


7. The Content can not be used in any manner that violates the artist, photographer, copyright-holder, model or models appearing in the image, or copyright-holders of any items visible in the image. Should there be any doubt about what constitutes copyright of items present in the image, one must immediately contact crestock.com to clarify this.
   


8. The buyer, or his/her employer cannot transfer the bought, downloaded Content, copies thereof, or the acquired right of use, to a third party.
   


9. Creative Visual Group AS cannot be held responsible for any disagreement that arise between the buyer/buyers, its employer and a third party, due tothe aforementioned use of Content bought and downloaded from www.crestock.com, or any economic consequences thereof.
   


10. The downloaded Content can only be used for graphic or design purposes, and cannot be used or multiplied as independent pieces of photographic art or on items for re-sale such as postcards, posters, t-shirts, mouse mats, mugs and similar.
    


11. Should the buyer or its employer use images contrary to the terms as described in paragraphs 4-10 above, the buyer will compensate by paying 300% of the fixed price per download, per incident of illegal use.
    


12. Should there be any disagreements on the terms, Norwegian law will apply. Salten Tingrett, Bodø Norway carry as sole legal venue.
    
    I confirm that I have read and accepted the terms as described above, and that this is to be understood as a binding contract between me and Creative Visual Group AS, the owner of www.crestock.com.  

CRESTOCK UPLOAD AGREEMENT (for Crestock contributors)

• This is a contract between Crestock (Creative Visual Group AS) and Suppliers that intend to upload Content (images, photos, illustrations, stills, animations and the like) onto Crestock's homepage www.crestock.com for use by Crestock's  customers. The Supplier must confirm that he or she has read, understood and agreed to the terms of this contract. 
  


• The Supplier will receive 20% of the sale price per credit sale (images bought with credits) and $0.25 per subscription sale (images bought by subscribers). The payment will be executed via PayPal (www.paypal.com) and paid out to the Supplier once $50USD is accumulated in his/her Crestock account. The parties agree that the sale price can be re-evaluated by Crestock at any time.
  


• By uploading Content to www.crestock.com, the Supplier admits a non-exclusive licence to display the uploaded Content on Crestock's homepage (www.crestock.com). Furthermore this allows Crestock to sub-licence the uploaded image to Crestock's customers for potential download. This in accordance with the terms of the Crestock Content Licence Agreement, a copy of which you have read, and acknowledge understanding and agreeing to.
  


• No title, copyright or intellectual property rights are transferred or granted in any way to Crestock or any third party. The Parties agree that all rights in and to the uploaded Content shall be retained by the Supplier.
  


• The Supplier warrants that he or she inhabits all rights both artistically, professionally, to the Content. Should there be any recognisable people in the uploaded Content, the Supplier will warrant and upload a Model Release along with the file.
  


• The Supplier understands that Crestock will not accept Content that infringes on any trademark, copyright, trade secret, right of privacy, patents, right to publicity or any other applicable law or property right, to be uploaded to the Crestock website (www.crestock.com).
  


• Crestock inhabit the rights to, at our good judgement, to remove Content from our website (www.crestock.com), if there is no or only a limited interest to download the Content by Crestock's members and/or customers.
  


• Crestock contributors may not buy their own images.
  


• You agree that Crestock is not to be held responsible for any damages caused by the use or inability to use the Content.
  


• The Supplier is responsible for any challenges from a third party concerning copyrights.
  


• You agree to hold Crestock harmless from any claims concerning the recording, upload, publishing, use of the Content, that have been breached by you, the Supplier.
  


• The Suppliers are themselves responsible for paying any applicable taxes relevant as a result of payments from Crestock.
  


• The Supplier warrants that the uploaded Content does not contain computer damaging material, such as virus and the like. 
  


• Crestock users (including contributors and buyers) may not misuse or exploit the systems or features at www.crestock.com in any way. Crestock reserves the right to determine what constitutes misuse or exploitation, and to ban and/or take legal action against members found to be in breach of this rule. 
  


• Should there occur twists, law suits, or other arguments concerning the relationship between Crestock and the Supplier, the chosen legal venue will be Salten Tingrett, Bodø, Norway.
  
  You admit to having read, understood and accepted this contract. You agree to be bound to the terms and conditions herein.
