Hello,
Today I was taking a look at the Best Image of the Day archive, and I found the image chosen for 19th of December 2007 (the head horse nebula).
I also consider this image as a wonderful one (I have some interest in astrophotography, and I know how much money you have to spend to take a decent - at least - photo of any celestial object).
When I saw that image (I knew it from other microstock sites), I thought that the guy that had it in his portfolio was quite lucky to have such an amazing equipment that allowed him to make such wonderful photos.
But what was my surprise when I saw in the comments below the image that actually that photography was not of our contributor colleague, but it was taken directly from the free image database of the NASA, retouched a little and then uploaded to this site (and many others).
I can barely begin to imagine how much (public) money does it takes to make such photographies (and then find that someone is selling that images as his/her own).

Well... and here comes the second part of the history.
Our fellow contributor has added one very funny? delirious? strange? (whatever) comment to one of my photographies:

As you can see, he thinks that all people works in the same way he does (in Spain we say "the thief thinks that all people are his way").

Well, I have to tell you that that wonderful lips come from my girlfriend. Yes, my friend, I have this luck!!!
Sorry for you that you have to compose beautiful lips to have some in your gallery!

I have them all the time with me!

And it's not only that! I have all the photographies (and their COPYRIGHT, you know what does it mean, don't you) of the vectors I make!

Well, enough time for such a stupid issue.

Talking serious, if Crestock wants to avoid future problem, the copyright issue should be treated in a more strict form. We can always make a punctual mistake, but there are some rules that should not be broken.

I believe that the guy you are talking about is a thief and a fraud and should be kicked of all the stock sites for his behaviour. He explains in the post in question that he uploaded the images (plural NOT singular) by mistake. ONE image uploaded to ONE site is a mistake but the amount he's uploaded to a number of sites proves that this is no mistake and he should be uncovered as the robber he surely is. I think we should make it a point to report people like this to the people they've stolen the images from and the administrators of the sites he's trying to sell them on.

You blacken the name of all of us trying to make an honest extra paycheck.

Shame on you sir.

I have seen some surprising copyright violations on stock sites. One would expect the reviewers to catch them, and ask the photographer for a property release.

Of course, reviewing hundreds of photos, and focusing on quality, it would be easy to miss something like that.

It shouldn't be this way!
when in other sites someone like this "photographer" has been discovered the site has not got any problem to kick him out.
Is our reputation what is here in doubt, and this is more important than a little incoming from a non reliable submitter.

Ok,

Well, first, its hard to keep a track of these complaints when you're using the comments on the best picture of the day, reviews on each others images, and, finally, the forum to express your concerns. At least, please address your concerns to the forum or by contacting helpdesk, so that we can handle these issues properly.

The comments you left via the reviews of images have now been removed. Customers won't want to see these.

The image that I was aware, the image of the day from the 19th of December 2007, was handled by one of my colleagues, I believe.

Crestock accepts properly credited NASA images which are part of an original composition with a strong concept. Any contributions that feature unaltered or slightly altered NASA images as a main part of the composition will be rejected for copyright infringements.

Thanks for removing the comments to my lips image, I wont remove the comment till I will be sure the Crestock team was aware of it.
I'm not sure NASA give her permission to sell the images their share on the web, I think they offer the images for non commercial issues, but this is far away from the principal issue in the post.
I'm not happy sharing microstock spacewith people who are not proud, and legal, sorry but this is how I feel.

Heres what NASA says on their website:

If the NASA material is to be used for commercial purposes, especially including advertisements, it must not explicitly or implicitly convey NASA's endorsement of commercial goods or services. If a NASA image includes an identifiable person, using the image for commercial purposes may infringe that person's right of privacy or publicity, and permission should be obtained from the person.

So from NASA's point of view, commercial use of their images are in fact ok. But, as Josh said, if no creative work has been done on them, they will be rejected by Crestock.

But changing levels in the image and removing some stars or making a smallest crop of the original image will not be accepted in Crestock?
